These Terms govern use of the Mahantam RX Inc. d/b/a Nate's Pharmacy website, online store, content, and related online services.

 

1. Acceptance

• By accessing the website, creating an account, submitting information, placing an order, requesting services, or using online features, you agree to these Terms, the Privacy Policy, Refund and Returns Policy, Shipping/Pickup/Local Delivery Policy, and any additional terms presented at checkout or service request.

 

2. Eligibility and Accurate Information

• You must be legally able to use the website and place orders. You agree to provide accurate, current, and complete information and to update it as needed.
• We may refuse service, cancel orders, or restrict accounts if information appears inaccurate, incomplete, fraudulent, unauthorized, unsafe, or non-compliant.

5. Prescription Medicine Requirements

• Prescription medications require a valid prescription from a licensed prescriber, pharmacist review, and all legally required verification before dispensing, delivery, or shipment.
• Nate's Pharmacy may refuse, hold, cancel, transfer, or require additional review for any prescription-related request where required or appropriate for patient safety, professional judgment, fraud prevention, inventory, payer rules, prescriber issues, controlled substance rules, product stability, or law.

 

6. Product Information and Labels

• We try to provide accurate product names, descriptions, images, prices, availability, warnings, and other information. Errors, delays, manufacturer changes, packaging changes, typographical mistakes, and system issues may occur.
• If the website description differs from the product label, follow the product label and contact the pharmacy or manufacturer with questions.

• To the fullest extent permitted by law, Mahantam RX Inc. d/b/a Nate's Pharmacy and its owners, officers, employees, contractors, vendors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising from or related to website use, orders, delays, errors, product availability, delivery, shipping, third-party services, or inability to use the website.
• Nothing in these Terms limits liability that cannot be limited under applicable law.

• You agree to defend, indemnify, and hold harmless Mahantam RX Inc. d/b/a Nate's Pharmacy and its owners, officers, employees, contractors, vendors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, inaccurate information, fraud, unlawful conduct, or violation of another person's rights.

 

16. Force Majeure

• We are not responsible for delays, failures, or inability to perform caused by events outside our reasonable control, including weather, emergencies, public health events, labor issues, supply shortages, carrier delays, technology failures, payment processor issues, cyber incidents, utility outages, government actions, recalls, regulatory restrictions, or prescriber/insurance delays.

 

17. Governing Law and Venue

• These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Subject to any mandatory consumer rights, disputes may be brought in the state or federal courts serving Kings County, New York.
• Do not add arbitration, class-action waiver, or jury-trial waiver language unless reviewed by counsel for enforceability and business preference.

• We may update these Terms and related policies at any time. Updated versions will be posted on the website with a revised last-updated date. Continued use of the website after updates means you accept the updated terms, to the extent permitted by law.
