These Terms govern use of the Mahantam RX Inc. d/b/a Nate's Pharmacy website, online store, content, and related online services.

 

1. Acceptance

  • By accessing the website, creating an account, submitting information, placing an order, requesting services, or using online features, you agree to these Terms, the Privacy Policy, Refund and Returns Policy, Shipping/Pickup/Local Delivery Policy, and any additional terms presented at checkout or service request.

  • You must be legally able to use the website and place orders. You agree to provide accurate, current, and complete information and to update it as needed.
  • We may refuse service, cancel orders, or restrict accounts if information appears inaccurate, incomplete, fraudulent, unauthorized, unsafe, or non-compliant.

  • We try to provide accurate product names, descriptions, images, prices, availability, warnings, and other information. Errors, delays, manufacturer changes, packaging changes, typographical mistakes, and system issues may occur.

  • You agree to defend, indemnify, and hold harmless Mahantam RX Inc. d/b/a Nate's Pharmacy and its owners, officers, employees, contractors, vendors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, inaccurate information, fraud, unlawful conduct, or violation of another person's rights.

 

16. Force Majeure

  • We are not responsible for delays, failures, or inability to perform caused by events outside our reasonable control, including weather, emergencies, public health events, labor issues, supply shortages, carrier delays, technology failures, payment processor issues, cyber incidents, utility outages, government actions, recalls, regulatory restrictions, or prescriber/insurance delays.

  • These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Subject to any mandatory consumer rights, disputes may be brought in the state or federal courts serving Kings County, New York.
  • Do not add arbitration, class-action waiver, or jury-trial waiver language unless reviewed by counsel for enforceability and business preference.
